Celebrating One Year!

We are pleased to announce that Erik Johanson PLLC celebrated its one-year anniversary on July 1, 2021.

During the past year, we have been honored to serve the legal needs of the Tampa business community. Our key to success has been simple: we devote ourselves to achieving our clients’ objectives.

With the support of our clients and friends, we recently established a new office location at 3414 West Bay to Bay Boulevard, Suite 300, Tampa, FL 33629. If you have not already visited our office, we invite you to stop by and see how we are continuing to grow our practice.

As we begin our second year, I want to thank my family, particularly Felicia Johanson, Bailey Johanson, and Fred Johanson, for their unwavering support. I also want to thank you: my clients, friends, and colleagues, for your trust and confidence. I am eternally grateful for all that you have done to make this firm a success.

HIGHLIGHTS OF THE YEAR:

Four day federal bench trial
Represented the plaintiff on claims for breach of contract and implied covenants of good faith and fair dealing in a 4-day bench trial before the U. S. Bankruptcy Court for the Middle District of Florida, Tampa Division. The trial resulted in a complete settlement following the submission of the case to the Court for disposition.

Settlement of complex ADA/Rehabilitation Act lawsuit in federal court
Represented the plaintiff in a complex ADA/Rehabilitation Act lawsuit against a local university in the United States District Court for the Middle District of Florida, Tampa Division. After extensive discovery and a full day judicial settlement conference, the parties reached a comprehensive settlement.

Confirmation of Jointly Administered SubChapter V Bankruptcy cases for an individual and professional association
Represented an accountant and her accounting firm in a comprehensive business restructuring before the United States Bankruptcy Court for the Middle District of Florida, Fort Myers Division. After three months of negotiations, the Debtors confirmed a consensual chapter 11 plan of reorganization that restructured more than $2 million in secured and unsecured debt.

Obtained dismissal of chapter 11 bankruptcy case for major creditor of bankrupt charter school
Represented the major creditor of a bankrupt charter school in Southwest Florida. Successfully advocated for dismissal of the bankruptcy case based on the debtor’s present inability to reorganize under chapter 11.

Successful eviction of tenant in commercial eviction dispute
Represented the plaintiff in a commercial eviction in Pasco County, Florida. The case resulted in the entry of a consent judgment for eviction and release of registry rent to the landlord.

Confirmation of Jointly Administered SubChapter V Cases for medical practice and affiliate
Served as co-counsel and special litigation counsel to a medical practice in a complex jointly administered chapter 11 reorganization in the United States Bankruptcy Court for the Middle District of Florida, Tampa Division. The cases were confirmed over the unsuccessful objection of the estates’ largest unsecured creditor.

Argued complex foreclosure appeal before Second District Court of Appeal
Represented the appellant in an appeal of a non-final order before the Second District Court of Appeal. The case was dismissed and remanded for further consideration after a spirited colloquy with the Court. Settlement of multi-year proceedings supplementary
Represented the defendants in a multi-year complex proceedings supplementary following the entry of a $4 million non-dischargeable final judgment in the United States Bankruptcy Court for the Middle District of Florida, Tampa Division. After vigorously defending the proceedings supplementary, the parties reached a complete and confidential settlement.

Settlement of commercial real estate dispute in Ybor City
Represented the defendants in a complex real property dispute in the Thirteenth Judicial Circuit in and for Hillsborough County, Florida. After discovery and motion practice, the case resulted in a complete settlement.

Served as testifying expert in attorney’s fee dispute
Served as an expert witness on the reasonableness of attorney’s fees in a complex fraudulent transfer lawsuit in the Twentieth Judicial Circuit in and for Lee County, Florida.

Representation of owner of St. Petersburg hotel in receivership case
Represented the owner of a hotel in downtown St. Petersburg in a receivership proceeding in the Sixth Judicial Circuit in and for Pinellas County, Florida. Successfully negotiated resolution of the case with counsel for the receiver and secured lenders.
